Your Right to a Mortgage Payoff Statement
I hope you all are doing well. This week, I would like to discuss your right to a mortgage payoff statement.
In our law practice, we sometimes hear homeowners complain that they are having problems getting an itemized payoff statement from their mortgage lender.
Under Florida law, you have the right to receive an accurate, itemized payoff statement from your mortgage company within 14 calendar days of the date of your written request for the payoff statement. Florida Statute 701.04 provides you with this right.
To get your itemized payoff statement, put your request in writing and send it to your lender's payoff department at their designated address. Make sure the request contains your property address and your mortgage loan number. I would also send it certified mail, return receipt requested.
Please also keep in mind that for the request to be considered a valid request under Florida law, you must attach a copy of your deed to the request.
You can pull an electronic copy of your deed by searching the online official records through your county clerk of court's website.
